The Social Aisle (ABN 59 667 067 085) operates this website and online store (thesocialaisle.com.au) and the Virtual Aisle guestbook platform (app.thesocialaisle.com.au), including all related information, content, features, tools, products and services (together, the "Services"). The Social Aisle is an Australian business based on the Sunshine Coast, Queensland, and is powered by Shopify for its ecommerce operations.

This Privacy Policy describes how we collect, use, store and disclose your personal information when you visit, use or make a purchase through the Services, or when you leave a message on a Virtual Aisle guestbook page. We are bound by the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing and disclosure of your personal information.

Personal Information We Collect or Process

When we use the term "personal information," we are referring to information that identifies or can reasonably be linked to you or another person. Personal information does not include information that is collected anonymously or that has been de-identified so that it cannot identify or be reasonably linked to you.

We may collect or process the following categories of personal information, depending on how you interact with the Services, where you live, and as permitted or required by applicable law:

Contact details including your name, address, billing address, phone number and email address.

Financial information including credit card, debit card and financial account numbers, payment card information, transaction details, form of payment, payment confirmation and other payment details.

Subscription and recurring billing information including your subscription plan type, billing cycle, subscription start and cancellation dates, payment authorisation for recurring charges, and credit usage history for Bundle Pack and Subscription Plan customers. This information is used to manage your ongoing plan and process monthly billing.

Account information including your username, password, security questions, preferences and settings.

Transaction information including the items you view, put in your cart, add to your wishlist, or purchase, return, exchange or cancel, and your past transactions.

Communications with us including the information you include in communications with us, for example, when sending a customer support enquiry.

Device information including information about your device, browser or network connection, your IP address and other unique identifiers.

Usage information including information regarding your interaction with the Services, including how and when you interact with or navigate the Services.

Virtual Aisle guestbook content including your name (if provided), any video message you record, any written message you type, and any answers you provide to advice card prompts when leaving a message on a Virtual Aisle guestbook page. Video recordings may contain your image and voice, which may constitute biometric information under Australian privacy law.

We may collect personal information from the following sources:

Directly from you including when you create an account, visit or use the Services, communicate with us, leave a guestbook message, subscribe to a plan, purchase a Bundle Pack, or otherwise provide us with your personal information.

Automatically through the Services including from your device when you use our products or services or visit our websites, and through the use of cookies and similar technologies.

From our service providers including when we engage them to enable certain technology and when they collect or process your personal information on our behalf.

From our partners or other third parties.


How We Use Your Personal Information

Depending on how you interact with us or which of the Services you use, we may use personal information for the following purposes:

Provide, Tailor and Improve the Services. We use your personal information to provide you with the Services, including to process your payments, fulfil your orders, remember your preferences, send notifications related to your account, process purchases, returns, exchanges or other transactions, create and manage your account, arrange shipping, and create a customised shopping experience for you. For the Virtual Aisle guestbook, we use your information to deliver your message to the event host, make it available in their private gallery, and provide the guestbook service as described below.

Manage Subscriptions and Bundle Packs. For customers on a monthly Subscription Plan or holding a Bundle Pack, we use your personal information to process recurring monthly charges, track credit usage and remaining balances, send billing confirmations and renewal reminders, manage plan upgrades, downgrades and cancellations, and communicate information relevant to your account.

Marketing and Advertising. We use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you online advertisements on the Services or other websites. You may opt out at any time using the unsubscribe link in any marketing email.

Security and Fraud Prevention. We use your personal information to authenticate your account, provide a secure payment experience, detect and investigate possible fraudulent or malicious activity, protect public safety, and secure our services.

Communicating with You. We use your personal information to provide customer support, respond to your enquiries, and maintain our business relationship with you.

Legal Reasons. We use your personal information to comply with applicable law, respond to valid legal process including requests from law enforcement or government agencies, investigate or participate in legal proceedings, and enforce or investigate potential violations of our terms or policies.


How We Disclose Personal Information

In certain circumstances, we may disclose your personal information to third parties for legitimate purposes subject to this Privacy Policy. Such circumstances may include:

With Shopify, vendors and other third parties who perform services on our behalf (e.g. IT management, payment processing, recurring billing management, data analytics, customer support, cloud storage, fulfilment and shipping).

With Cloudflare (for Virtual Aisle video storage via Cloudflare R2) and Supabase (for guestbook data storage). These services may store data on servers located outside Australia — see International Transfers below.

With business and marketing partners to provide marketing services and advertise to you.

When you direct, request or otherwise consent to our disclosure of certain information to third parties.

With our affiliates or otherwise within our corporate group.

In connection with a business transaction such as a merger or acquisition, to comply with any applicable legal obligations, or to protect or defend our rights and the rights of our users.

We will never sell your personal information to third parties.


Virtual Aisle Guestbook — Specific Terms

This section applies specifically to guests who leave a message on a Virtual Aisle guestbook page.

Who can see your message. Messages left on a Virtual Aisle page are visible only to the event host, who accesses their private, password-protected gallery. Guests cannot see each other's messages. The Social Aisle team may access messages only for the purposes of technical support or to investigate a reported issue, and we do not routinely view guest content.

Video recordings and biometric information. When you record a video message, your recording may contain your image, voice and other biometric-like information. By submitting a video message, you consent to that recording being stored and made available to the event host as described in this policy. You are never required to record a video — you may always choose to leave a written message or advice card response instead.

No account required. Guests are never required to create an account or provide an email address to leave a message. Your name is optional.

Retention. Guest messages remain available to the event host for the duration of their active plan period. After your plan expires, messages remain accessible for 30 days, then are permanently and automatically deleted from our systems, including all video files. We will send you a reminder email 14 days before your page expires so you have time to download your gallery. You can download your gallery at any time before deletion.

Requesting deletion of your message. If you would like your message or video recording removed, please email hello@thesocialaisle.com.au with your name, the approximate date of your message, and the name of the event. We will action deletion requests within 30 days.

Privacy notice. When you leave a message on a Virtual Aisle page, you will be shown a brief notice that your message will be shared privately with the event host, with a link to this Privacy Policy.


Subscription Plans and Bundle Packs — Specific Terms

This section applies to customers on a monthly Corporate Subscription Plan (Starter, Team, Growth, or Enterprise) or who have purchased a Bundle Pack of guestbook credits.

Recurring billing data. For Subscription Plan customers, we store your payment authorisation, billing cycle dates, and subscription history for as long as your subscription remains active and for a reasonable period after cancellation to resolve any billing disputes, comply with legal obligations, and maintain financial records. This data is processed by Shopify's subscription billing infrastructure.

Credit usage records. For both Subscription Plan and Bundle Pack customers, we maintain records of how many credits have been issued, redeemed, and remain available in your account. These records are retained for the life of your account and for a period thereafter for audit and dispute resolution purposes.

Cancellation. When you cancel a Subscription Plan, your billing information is retained by Shopify for the period required by law and Shopify's own data retention policies. You may request deletion of your account data by contacting us directly, subject to our legal obligations to retain certain financial records.

Corporate team use. If you are purchasing on behalf of an organisation, you represent that you are authorised to provide the personal information submitted (including payment and contact details) and that your organisation's team members whose celebrations are facilitated through the platform have been informed that their event details may be stored as part of the guestbook record.


Relationship with Shopify

The ecommerce Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the ecommerce Services will be transmitted to and shared with Shopify, as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you. Shopify also powers our subscription billing infrastructure for recurring monthly plans.

Third Party Websites and Links

The Services may provide links to websites or other online platforms operated by third parties. We are not responsible for the privacy or security of such sites. Our inclusion of such links does not imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.


Children's Data

The Services are not intended to be used by children, and we do not knowingly collect personal information about children under the age of majority in your jurisdiction. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details set out below to request that it be deleted.

As of the effective date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" (as those terms are defined in applicable law) personal information of individuals under 16 years of age.


Security and Retention of Your Information

Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee perfect security. Information you send to us may not be secure while in transit. We recommend that you do not use unsecured channels to communicate sensitive or confidential information to us.

How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, provide you with the Services, comply with legal obligations, resolve disputes or enforce applicable contracts and policies. Your Rights and Choices

Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. These rights are not absolute, may apply only in certain circumstances and, in certain cases, we may decline your request as permitted by law.

Right to Access / Know. You may have a right to request access to personal information we hold about you.

Right to Delete. You may have a right to request that we delete personal information we maintain about you.

Right to Correct. You may have a right to request that we correct inaccurate personal information we maintain about you.

Right of Portability. You may have a right to receive a copy of the personal information we hold about you and to request that we transfer it to a third party, in certain circumstances and with certain exceptions.

Managing Communication Preferences. We may send you promotional emails, and you may opt out of receiving these at any time by using the unsubscribe option displayed in our emails to you. If you opt out, we may still send you non-promotional emails, such as those about your account, orders, or subscription billing.

You may exercise any of these rights by contacting us using the contact details provided below. We will not discriminate against you for exercising any of these rights. We may need to verify your identity before we can process your requests.


Australian Privacy

We are bound by the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth). This includes obligations to collect only information that is reasonably necessary, to notify you at or before the point of collection, to store your information securely, and to provide you with access to and the ability to correct your personal information on request.

International Transfers

Please note that we may transfer, store and process your personal information outside the country you live in, including to the United States and other countries where our service providers operate.

For ecommerce and subscription billing data processed by Shopify, please refer to the Shopify Consumer Privacy Policy for details of applicable transfer safeguards.

For Virtual Aisle guestbook data, video recordings are stored using Cloudflare R2 and text data is stored using Supabase. Both services may store data on servers located outside Australia. We take reasonable steps to ensure that overseas recipients handle your personal information in a manner consistent with the Australian Privacy Principles.

If we transfer personal information out of the European Economic Area or the United Kingdom, we will rely on recognised transfer mechanisms like the European Commission's Standard Contractual Clauses, or any equivalent contracts issued by the relevant competent authority of the UK, as relevant, unless the data transfer is to a country that has been determined to provide an adequate level of protection.


Changes to This Privacy Policy

We may update this Privacy Policy from time to time, including to reflect changes to our practices or for operational, legal or regulatory reasons. We will post the revised Privacy Policy on this website and update the "Last updated" date. Continued use of the Services after changes are posted constitutes acceptance of the updated policy.
